My mother was born in cuba can I get residence also?

Residency in Cuba is a complex issue, the best you can do is contact the Cuban embassy in your Country. There are different types of Residency in Cuba. The permanent residency, is only allowed
when the foreigner is married to a Cuban citizen,
has an income, a place to live, and has made a bank deposit of 5000 Cuc. Note that with a permanent residency you can't leave Cuba without an Cuban exit visa.
On the other hand there are several temporary Cuba visa, for work in Cuba, family reasons, medical reasons etc.
You really need to contact the Cuban immigration services they can explain you all the possibilities, these visa's are often subjet to changes.

P.S what i mean in my response below by a having a family member With (Foreign Permanent Residency) is someone that is a foreigner that was granted permanent residency in CUBA.

I understand what you mean now by real foreigners. A real foreigner has no ties what so ever such as a Cuban National or a foreign permanent resident.

however you are forgetting that our responses were in regards to the woman question above.She would like to apply for residency because her mother was born there. So what i was saying is the correct way to answer her question is not to say she needs to be married but in fact it is down to whether or not her mother is still a resident of cuba. Also I would like to add that the 5,000cuc will still be required if she is over 18 and hasn't applied for cuban nationality.

You are right, many of the cuban consulates interpret the law wrong which is quiet sad really, however the immigration office that deals with residency applications in Cuba are well aware that one does not need to be married.

I knew what you meant by foreigner.
I still stand by my previous comment, Your advice is wrong.

A foreigner does not need to be married, they may apply for residency in the following circumstances only if the following are residents of Cuba;

A) Married to cuban
B) have a Cuban child
C) Cuban Mother or Father
D) Mother or Father foreign permenant residents

exceptional circumstances will be made for extended family members and if the applicant does not meet none of the above examples. Each case will be assesed on its merits. It is stated clearly in the law.

the examples I have mentioned indicates that a real foreigner may still be granted permenant residency without being married.

A major problem in Cuba..... a lot of the rules are vague. For example the Cuban embassy in Brussels stated that some documents were obligatory to marry in Havana. First thing they said in Havana Cuba (the notary who led the ceremony) this is wrong and threw the documents away. I have confronted Cuban officials with rules printed out of their official website. The rules were not correct they said. Just to say getting correct information is not easy in Cuba, therefore I stand by the general principles: a pure foreigner with no Cuban ties has to establish Cuban ties by marrying a Cuban citizen.
Otherwise they can only get a temporary residence.
The cases you mention under A,B,C,D are not pure foreigners, they are all related to having Cuban family and/or roots, in that case you're right they need no marriage to a Cuban citizen, they have already (family) ties with Cuba. There are many exceptions to these rules (not only in Cuba) that's why I stick to the basic principles and does not talk about a variety of rules and options.

Your advice is wrong, If a foreigner has a spouse, mother, father or child that is a cuban citizen one can apply for permenant residency. This is clearly stated in Cuban Law.

By a "foreigner" I mean a NON-CUBAN citizen, of course when your family (mother, father etc.) is Cuban other family members can get a permanent residency too. NOTICE that a Cuban citizen can not get a dual nationality, (can not become a foreigner) he/she will always be regarded by the Cuban government as a Cuban citizen!! Even a Cuban citizen living in the US
with a US nationality will be regarded (and treated) as a Cuban citizen. When he/she has fled illegal out of the country they can face prison time.

P.S in answer to the persons question above, as long as her mother is still a PERMENANT RESIDENT OF CUBA, she may apply for PERMENANT RESIDENCY and is not required to be married to a cuban but will still be required to deposite the 5,000cuc

The law states to get cuban permenant residency one must have a cuban permenant resident: FATHER,MOTHER,SON,DAUGHTER OR SPOUSE, if one does not meet this requirment it is down to the discretion of immigration, no were in the law does it state ONE MUST BE MARRIED.

When a FOREIGNER applys for a permanent residency he/she has to be married to a Cuban citizen.
By "FOREIGNER" I mean a non-Cuban citizen, a person without Cuban roots, family or Cuban citizenship.

There are different types of residency, temporary and permanent. To the best of my knowledge, it's still necessary to be married to a Cuban citizen and make a bank deposit of 5,000 Cuc, in order to get a PERMANENT residency visa. All other residencies are temporary and marriage is not needed!
