DIVORCE FOR FOREIGN NATIONALS - Cuba

Since the Cubans marry under fraud intentions, I think the money being charged for a foreign national to get a divorce is too much. Considering that it was the foreign person who paid for the marriage and put all of the money into the relationship to make it work. Some consideration should be given to this.

I do understand your consideration, Twyla and it is my intention to warn for this abuse and fraud, but after all if the marriage is signed in Cuba according to the Cuban law, it has to follow the Cuban divorce agreements. In general for the Cuban law all assets will be split in two equal parts between the ex-partners. In most cases the foreign partner is the loser, the foreigner has to take some precautions and seek legal advice BEFORE She/He contracts a Cuban marriage!

If they are in Cuba and you never brought them back to your country then just forget about the marriage and the women, that's all. Believe me you are safe from reprisals.

They will get married again and will tell a court you abandoned and the Cuban can get a divorce for $5.00

If your Cuban wife is in Cuba, just forget about her. You do not need a divorce from her if she is in Cuba as the Cuban can get a divorce for $5.00.

If your spouse (Cuban) is in Canada a divorce in Cuba will not be recognized here in Canada.

In Canada do to them what they will eventually do to you, call the police as they assaulted you, have them permanently removed from your home.

If you live in Cuba and you get a divorce only what you accumulated after getting married is split 50/50.

How to get divorce in Cuba?

We are both from Slovakia, got married in Cuba through an agency three years ago, we have never registered marriage in Slovakia as we have separated few month after marriage.
I have contacted embassy and they recommended me to find a lawyer who could divorce us in cuba without our presence.
But nobody seems to know any lawyer who could do it.
I am not sure if i can find anyone who i can trust on internet.
What would you advise me to do?
Where to look for a lawyer?

I only got married in Cuba. I did have to go to the Cuban Consulate in Toronto and I paid about $700.00 Cdn. for something regarding the Cubana (my wife) to come to Canada. I do not think I made the marriage legal here in Canada. Could I have made the marriage here in Canada from the papers I signed at the Cuban Consulate??

A. I don't think so, but I am no lawyer, in case of doubt contact your lawyer

I also heard regarding Cuban divorces that only what we acquired together and since we were married is split 50/50. What we came into the marriage with is still each of own. Do you know if this is true?
A. It seems to be common practice in Cuba, unless the judge in Cuba decides otherwise.
Are you prepared to lose 50% of your assets in
a bad marriage deal? Consult a lawyer and get a divorce in Cuba, it can be done without much red tape.

I need some info. too

I need information PLEASE. I got married in Cuba to a Cuban woman who is now in Canada. this Cuban woman is abusing me physically and mentally. Can anybody tell me if I can go to Cuba and get a divorce by paying a lawyer there. I only have a home here in Canada and a small pension.

Any information will help. I might be going there to see a lawyer this May or early June 2011.

You have to act carefully and fast!
Contact a Cuban laywer and ask him to file for a divorce in Cuba, this can be done in Cuba without her consent or agreement.

But other laywers in Cuba can do this too.
Have you legalized the marriage in Canada? In this case contact a Canadian lawyer to protect your assets and do it before she asks compensations. Note, that when she's living in Canada you can be obliged to pay her social security after a divorce! (I don't know the exact details of the Canadian legislation, ask your lawyer or Immigration Services)
There are several examples of people that lost half of their possesions including their house.
I heard about a guy living in London, who lost half of his property when his (ex) Cuban wife hired a British laywer to claim half of his property. Also ask information at the Cuban embassy it seems that a divorce can be done through the embassy (I am not sure about this and have no details)

Hope you understand my poor English, but here is how I got my divorce:
I went to a local laywer (BES Bufete de Servicios Espesializados)with my "Certificacion de Matrimonio" and 1400 CUC (should be enough for the translation too)and asked for a "divorcio por Justa Causa".
Tipping is wellcome and make thing more smooth.
You don't need to show up in court, but here is the important, if your counterpart do not show up (and they normally don't)they loose all their rights and, if you have no common children, it cost you nothing in the future.
You can tell the Laywer exactly what you want, they will never check it.
After a couple of month, call your laywer and he/she will tell you to go to a "Notario" with two respectable Cubans (the taxidriver can be one of them).
After app. 1 year call the laywer again and he/she will have the "Sentencia de Divorcio" and you are free to marry another Cuban (or whatever you want).

DO NOT MARRY CUBANS IN OR OUT SIDE CUBA

Do not wish for experience to be taught a wise lesson.
You will have to go to Cuba with more money than it took to get married, and divorce this man. With him not being there to receive the Petition served on him, it will have to be done out of the Jurisdiction of Cuba, advertised in the place where he is now living and the documents filed and notified in both places. My friend you have a lot of work and a lot of money to spend on Lawyers.
He will not be able to marry again until he gets a divorce, but he wont care about that.!!!!!!!! I would suggest take take out a summons, and take him to court for maintanance where he is living. When the court makes an order, he will have to pay that as long as you both are married if it is 50 years, unless he decide to return to Cuba and file a petition of divorce and pay for it.
Wishing you best of luck, and take my advice dont Marry, or fall in love with a Cuban again.

How do I get a Cuban divorce?

Well I fell for the Cuban hook, line and sinker. Now that he's in Canada he stated that he doesn't love me as a wife and that he's embarrassed to be seen with me in public because "I got fat". He also stated that his mother will always be number one and no woman will ever take her place. He moved out, wants to stay friends but now I want to get a divorce. We got married in Cuba only. Is there a way I can get a Cuban divorce without him knowing and if I can, where do I start?

Indeed a sad story Joanne and if it can be of any comfort...one of the many.
I am no lawyer so don't take my answer as a legal advise, ..."just an advice".
You are married in Cuba, so you have to divorce for the Cuban Authorities. It seems that this can be done through the Cuban Ambassy in Canada, but I am not sure about the procedure. What I strongly advise is to hire a lawyer in Cuba, it seems that there is a simple procedure to divorce
in Cuba from him without his agreement but the paperwork has to be done right. Watch out for financial disaster, protect your assets. In a Cuban-Foreigner marriage the Cuban party is most likely the "poor party" and has the possibility for a financial gain. So act quickly and efficient
and seek legal advice to protect yourself.
